§1 GENERAL PROVISIONS
These Terms and Conditions (“Terms”) define the rules for using the Online Store, including placing and fulfilling Orders, using a Customer Account, submitting complaints, and exercising the right to withdraw from a Sales Agreement.
The Terms are made available to Customers free of charge before entering into a Sales Agreement, allowing them to access, store, and reproduce the content using their IT system.
Customers must comply with all provisions of these Terms. Sales are governed by the version of the Terms in effect at the time the Order is placed.
Use of a Customer Account requires registration and acceptance of these Terms.
By creating a Customer Account, the Seller agrees to provide continuous access to the Customer Account and full use of the Online Store according to these Terms.
§2 DEFINITIONS
Seller: MART ZAKŁAD ELEKTRONICZNY JANUSZ CZAJKOWSKI, Stobno 52A, 72-002 Dołuje, VAT ID: 8510302827, REGON: 810032846, email: Biuro@mart-electronics.pl.
Customer: Any natural person with legal capacity, a person with limited legal capacity, a legal entity, or an organizational unit with legal capacity, using the Online Store.
Consumer: A Customer who is a natural person making purchases not directly related to their business or professional activity.
Parties: The Seller and the Customer collectively.
Sales Agreement: A distance contract under which the Seller sells Goods to the Customer according to these Terms.
Online Store: The platform at store.mart-electronics.pl, administered by the Seller.
IT System: Hardware and software enabling data processing, storage, and transmission via telecommunications networks.
Goods: Movable items offered in the Online Store. Product images are illustrative; actual appearance may vary.
Customer Account: An individual account allowing the Customer to access the Online Store and place Orders.
Electronic Address: Any electronic communication address, including email.
Price: Gross price of Goods in PLN, including VAT, excluding delivery costs.
Personal Data: Information about an identified or identifiable natural person.
Data Controller: The Seller, determining purposes and means of processing Personal Data.
GDPR: EU Regulation 2016/679 on the protection of personal data.
Order: The Customer’s declaration via the Online Store specifying Goods, delivery, payment, and contact information.
§3 ONLINE STORE OVERVIEW
The Online Store is operated by the Seller.
Wholesale purchases require direct contact with the Seller via Biuro@mart-electronics.pl. Wholesale Orders may be refused.
Product information is an invitation to make an offer, not a binding offer.
Product availability is not guaranteed.
Goods may be covered by a manufacturer, importer, or Seller warranty valid in Poland.
Prices, products, and descriptions may change; promotions may be introduced. Changes do not affect already placed Orders.
Access to the Online Store requires an Internet-enabled device, email account, and a modern browser supporting cookies.
Temporary unavailability may occur due to maintenance, updates, or security measures.
The Seller may update or modify Store functionality at any time.
§4 CUSTOMER ACCOUNT
Full access requires registration, acceptance of the Terms, and confirmation by the Seller.
Registration is optional to place an Order.
Registered Customers consent to electronic provision of Account services.
Login credentials must remain confidential.
Registration requires completing the form and accepting the Terms.
A confirmation email completes the registration.
The Seller may refuse registration for valid reasons.
§5 ORDERS AND PAYMENT
Orders may be placed 24/7 via the Online Store.
Orders can be placed with or without an Account.
To place an Order, the Customer selects Goods, delivery method, and payment option, then confirms the Order.
Sending an Order constitutes an offer to enter a Sales Agreement.
The Seller confirms acceptance via email, forming the contract.
Prices at the time of Order are binding.
Payment options include:
- Cash on delivery (if applicable)
- Prepayment via bank transfer or electronic payment
Customers are informed of payment details prior to completing payment.
Invoices are sent electronically via email.
Delivery is within Poland unless otherwise stated. Methods include courier, parcel locker, or in-person pickup.
Customers must inspect goods upon receipt. Damage should be documented and reported immediately.
Maximum fulfillment time is 30 days. Afterward, Orders may be canceled with full refund.
§6 TERMINATION OF ACCOUNT SERVICES
This section applies only to Customer Account services.
Customers may terminate services anytime via the Online Store.
The Seller may terminate with 14 days’ notice for valid reasons.
Services expire upon: death or liquidation of the Customer, or cessation of the Seller’s business.
§7 PERSONAL DATA PROTECTION
The Seller protects Personal Data according to GDPR and applicable laws.
Cookies and similar technologies are used to improve the Store and offer personalized ads. Opt-out options are available.

§8 LIABILITY
Customers must use the Store lawfully.
Illegal content or activity is prohibited.
The Seller is not liable for: email delivery issues, technical problems on the Customer’s side, or incorrect Customer data.
The Store may contain external links; the Seller is not responsible for their content.
Advertising may appear in the Store; the Seller is not liable for claims arising from ads.
For non-Consumers, liability is limited to the Price paid for the Goods; lost profits are excluded.
§9 WITHDRAWAL FROM SALES AGREEMENT
Consumers may withdraw within 14 days from receipt.
Withdrawal periods depend on order type (single/multiple items, ongoing deliveries).
Withdrawal is done by sending a statement to Biuro@mart-electronics.pl.
Upon withdrawal, the agreement is void; refunds include Goods Price and standard delivery. Consumers bear return shipping costs.
Goods must be returned in proper condition; refunds may be delayed until receipt.
Withdrawal does not apply to custom-made, perishable, sealed, or digitally delivered products under specific conditions.
§10 DEFECTIVE GOODS AND COMPLAINTS
The Seller delivers defect-free Goods.
Liability exists for physical or legal defects.
Consumers may request price reduction, repair, replacement, or withdrawal.
Complaints can be submitted via email or post.
Complaints should include Customer data, issue description, expectations, and proof of purchase.
Defective Goods must be returned; the Seller covers costs for Consumers.
Complaints are resolved within 14 days.
Customers receive information on complaint resolution via email.
§11 FINAL PROVISIONS
The Seller may amend the Terms unilaterally; changes are published online.
Amendments take effect 7 days after publication. Non-acceptance may result in Account termination.
Unregulated matters are governed by Polish law.
Parties should attempt amicable dispute resolution. Courts for disputes between entrepreneurs are located at the Seller’s registered office.
